This Artist Agreement (“Agreement”) is entered into by and between Carlos Cebrián Ruiz (“NoctiCraft”), operating as a sole proprietor, and the Artist submitting the official request form to participate in NoctiCraft events (“Artist”). By accepting this Agreement, the Artist agrees to be bound by the terms and conditions outlined herein.
The Artist agrees to participate in musical and artistic performances on the NoctiCraft Minecraft server, Discord platform, and any other media channels or digital platforms selected by NoctiCraft.
This Agreement applies to live music performances, DJ sets, pre-recorded content, lipsync acts, visual presentations, premieres, and other artistic formats approved by NoctiCraft.
All technical logistics and event execution will be handled by the NoctiCraft team. The Artist agrees to cooperate in any required setup, sound checks, or rehearsals.
The Artist warrants that they:
Own or hold commercial exploitation rights to their performance content;
Have permission from copyright holders when using third-party material;
Are not infringing on any intellectual property rights.
The Artist grants NoctiCraft a non-exclusive, royalty-free, worldwide license to record, reproduce, distribute, and publicly display their performances on all current and future platforms operated by NoctiCraft. For solo performances that generate direct revenue, the Artist shall receive 70% of the income, minus applicable transaction fees. No payments will be made for collective or non-original content unless explicitly agreed.
Unless separately agreed in writing, participation in events is voluntary and unpaid. When payment is agreed, it will be issued within 90 days of invoice submission via PayPal or bank transfer.
If the server enables direct tipping or donations for artists, the Artist will receive 100% of the donation, less applicable payment processing fees.
Users must be at least 16 years old to perform or participate in NoctiCraft events, with written parental or legal guardian consent. Purchases and financial transactions are limited to users 18 years or older.
This Agreement is valid for 5 years from the date of signature and renews automatically unless terminated in writing. NoctiCraft may terminate participation at any time due to technical, behavioral, or policy violations.
The Artist agrees to indemnify and hold NoctiCraft harmless against any claims arising from intellectual property infringement. The Artist will provide documentation upon request.
The Artist allows NoctiCraft to use their name, voice, image, and likeness for promotional purposes related to the platform, including marketing, highlight reels, and archival content.
This is a non-exclusive agreement. The Artist is free to perform elsewhere unless otherwise agreed for specific events.
NoctiCraft retains final control over creative and technical presentation. Adjustments may be made for quality, audience experience, or platform compatibility.
The Artist agrees to follow NoctiCraft’s code of conduct. Discriminatory, harassing, or toxic behavior will result in immediate termination.
Furthermore, the Artist shall be solely responsible for any legal claims, refunds, compensations, damages, penalties incurred by NoctiCraft, or reputational harm caused to NoctiCraft or its community as a result of their misconduct, including but not limited to harassment, hate speech, or inappropriate behavior during or in relation to NoctiCraft events.
Any internal or technical information about NoctiCraft must be kept confidential unless authorized in writing.
NoctiCraft is not responsible for off-platform interactions between Artists and fans. The Artist is solely accountable for such engagements.
Neither party is liable for failure to perform due to circumstances beyond their control, including server outages, health emergencies, or natural disasters.
If the Artist cancels their performance for reasons not qualifying as force majeure, or fails to appear at a scheduled event, the Artist shall be liable for any damages, losses, or reputational harm caused to NoctiCraft. In the case of exclusive or ticketed events, the Artist shall also be responsible for reimbursing ticket refunds to attendees and covering any resulting costs, fees, or penalties incurred by NoctiCraft.
The Artist is solely responsible for all tax obligations arising from their income via NoctiCraft.
Time spent in sound checks or technical tests is not compensated unless explicitly agreed in advance.
With written agreement, NoctiCraft may sell merchandise featuring the Artist’s likeness or performances under separate commercial terms.
NoctiCraft will not use the Artist’s content to train AI models or create synthetic works without express written consent.
NoctiCraft may repackage content (e.g., shorts, trailers, highlights) provided the Artist is not misrepresented.
Artists may request the removal of specific content for legal or reputational reasons. NoctiCraft will consider such requests in good faith but is not obliged to comply.
Official notices will be made through support@nocticraft.com or agreed Discord channels.
This Agreement may be transferred by NoctiCraft to affiliates or successors without additional consent.
This document represents the entire understanding and supersedes any prior discussions or representations.
If any clause is found invalid, the remainder of the Agreement shall remain in effect.
This Agreement is governed by Spanish law. Any disputes shall first be addressed by contacting support@nocticraft.com. If unresolved, the parties agree to resolve via private online arbitration before pursuing court proceedings in Spain.
By submitting the official artist request form or performing in NoctiCraft, the Artist agrees to all terms set forth in this Agreement.
