Al aceptar este Acuerdo, el Artista acepta estar sujeto a los t\u00e9rminos y condiciones aqu\u00ed descritos.<\/p><h3>1. Alcance del Acuerdo<\/h3><p>El Artista acepta participar en presentaciones musicales y art\u00edsticas en el servidor de NoctiCraft Minecraft, la plataforma Discord y cualquier otro canal de medios o plataforma digital seleccionada por NoctiCraft.<\/p><h3>2. Tipos de contenido<\/h3><p>Este Acuerdo se aplica a presentaciones de m\u00fasica en vivo, sesiones de DJ, contenido pregrabado, actos de sincronizaci\u00f3n labial, presentaciones visuales, estrenos y otros formatos art\u00edsticos aprobados por NoctiCraft.<\/p><h3>3. Responsabilidad t\u00e9cnica<\/h3><p>Toda la log\u00edstica t\u00e9cnica y la ejecuci\u00f3n del evento estar\u00e1n a cargo del equipo de NoctiCraft. El Artista acepta cooperar en cualquier montaje, prueba de sonido o ensayo requerido.<\/p><h3>4. Derechos y Licencias<\/h3><p>El artista garantiza que:<\/p><ul><li><p>Poseer o ostentar derechos de explotaci\u00f3n comercial sobre el contenido de sus interpretaciones;<\/p><\/li><li><p>Contar con permiso de los titulares de derechos de autor cuando utilice material de terceros;<\/p><\/li><li><p>No infringen ning\u00fan derecho de propiedad intelectual.<\/p><\/li><\/ul><p>El artista otorga a NoctiCraft una <strong>Licencia mundial, no exclusiva y royalty-free<\/strong> para grabar, reproducir, distribuir y mostrar p\u00fablicamente sus actuaciones en todas las plataformas actuales y futuras operadas por NoctiCraft. Para actuaciones en solitario que generen ingresos directos, el Artista recibir\u00e1 <strong>70% of the income<\/strong>, menos las tarifas de transacci\u00f3n aplicables. No se realizar\u00e1n pagos por contenido colectivo o no original a menos que se acuerde expl\u00edcitamente.<\/p><h3>5. Compensaci\u00f3n<\/h3><p>A menos que se acuerde por separado por escrito, la participaci\u00f3n en eventos es voluntaria y no remunerada. Cuando se acuerde el pago, \u00e9ste se emitir\u00e1 dentro de <strong>90 dias<\/strong> desde el env\u00edo de factura a trav\u00e9s de PayPal o transferencia bancaria.<\/p><h3>6. Donaciones<\/h3><p>Si el servidor permite propinas directas o donaciones para artistas, el Artista recibir\u00e1 <strong>100% de la donaci\u00f3n<\/strong>, menos las tarifas de procesamiento de pagos aplicables.<\/p><h3>7. Requisitos de edad<\/h3><p>Los usuarios deben tener al menos <strong>16 a\u00f1os<\/strong> para realizar o participar en eventos de NoctiCraft, con el consentimiento por escrito de los padres o tutores legales. Las compras y transacciones financieras est\u00e1n limitadas a los usuarios de <strong>18 a\u00f1os o m\u00e1s<\/strong>.<\/p><h3>8. Duraci\u00f3n y Terminaci\u00f3n<\/h3><p>Este Acuerdo es v\u00e1lido por <strong>5 a\u00f1os<\/strong> desde la fecha de la firma y se renueva autom\u00e1ticamente a menos que se rescinda por escrito. NoctiCraft puede cancelar la participaci\u00f3n en cualquier momento debido a violaciones t\u00e9cnicas, de comportamiento o de pol\u00edticas.<\/p><h3>9. Propiedad intelectual y garant\u00edas de artistas<\/h3><p>El Artista acepta indemnizar y eximir de responsabilidad a NoctiCraft contra cualquier reclamo que surja de la infracci\u00f3n de propiedad intelectual. El Artista proporcionar\u00e1 documentaci\u00f3n previa solicitud.<\/p><h3>10. Derechos promocionales<\/h3><p>El Artista permite a NoctiCraft utilizar su nombre, voz, imagen y semejanza con fines promocionales relacionados con la plataforma, incluido marketing, v\u00eddeos destacados y contenido de archivo.<\/p><h3>11. Exclusividad<\/h3><p>Esta es una posici\u00f3n de <strong>acuerdo no exclusivo<\/strong>. El Artista es libre de actuar en otro lugar a menos que se acuerde lo contrario para eventos espec\u00edficos.<\/p><h3>12. Control art\u00edstico y t\u00e9cnico<\/h3><p>NoctiCraft conserva el control final sobre la presentaci\u00f3n creativa y t\u00e9cnica. Se pueden realizar ajustes por calidad, experiencia de la audiencia o compatibilidad de plataforma.<\/p><h3>13. Conducta y est\u00e1ndares comunitarios<\/h3><p>El Artista acepta seguir el c\u00f3digo de conducta de NoctiCraft. El comportamiento discriminatorio, acosador o t\u00f3xico resultar\u00e1 en la finalizaci\u00f3n del acuerdo de forma inmediata. <br \/>Adem\u00e1s, el Artista ser\u00e1 el \u00fanico responsable de cualquier reclamaci\u00f3n legal, reembolsos, compensaciones, da\u00f1os,\u00a0<span style=\"font-size: 1rem\">penalizaciones incurridas por NoctiCraft<\/span><span style=\"font-size: 1rem\">, o da\u00f1o a la reputaci\u00f3n causado a NoctiCraft o su comunidad como resultado de su mala conducta, incluido, entre otros, acoso, incitaci\u00f3n al odio o comportamiento inapropiado durante o en relaci\u00f3n con los eventos de NoctiCraft.<\/span><\/p><h3>14. Confidencialidad<\/h3><p>Cualquier informaci\u00f3n interna o t\u00e9cnica sobre NoctiCraft debe mantenerse confidencial a menos que se autorice por escrito.<\/p><h3>15. Interacciones con los fans<\/h3><p>NoctiCraft no es responsable de las interacciones fuera de la plataforma entre Artistas y fans. El Artista es el \u00fanico responsable de dichos compromisos.<\/p><h3>16. Fuerza mayor<\/h3><p>Ninguna de las partes es responsable del incumplimiento debido a circunstancias fuera de su control, incluidas interrupciones del servidor, emergencias sanitarias o desastres naturales.<\/p><h3>17. Cancelaci\u00f3n del artista y no presentaci\u00f3n<\/h3><p>Si el Artista cancela su actuaci\u00f3n por motivos que no califican como fuerza mayor, o no se presenta a un evento programado, el Artista ser\u00e1 responsable de cualquier da\u00f1o, p\u00e9rdida o da\u00f1o a la reputaci\u00f3n causado a NoctiCraft. En el caso de eventos exclusivos o con entradas vendidas, el Artista tambi\u00e9n ser\u00e1 responsable de reembolsar los reembolsos de las entradas a los asistentes y cubrir cualquier costo, tarifa o penalizaci\u00f3n resultante en que incurra NoctiCraft.<\/p><h3>18. Comercializaci\u00f3n (opcional)<\/h3><p>Con un acuerdo por escrito, NoctiCraft puede vender productos que presenten la imagen o actuaciones del Artista bajo t\u00e9rminos comerciales separados.<\/p><h3>21. IA e identidad digital<\/h3><p>NoctiCraft no utilizar\u00e1 el contenido del Artista para entrenar modelos de IA o crear obras sint\u00e9ticas sin el consentimiento expreso por escrito.<\/p><h3>22. Derechos de edici\u00f3n seleccionados<\/h3><p>NoctiCraft may repackage content (e.g., shorts, trailers, highlights) provided the Artist is not misrepresented.<\/p><h3>23. Solicitudes de retiro<\/h3><p>Los artistas pueden solicitar la eliminaci\u00f3n de contenido espec\u00edfico por motivos legales o de reputaci\u00f3n. NoctiCraft considerar\u00e1 dichas solicitudes de buena fe pero no est\u00e1 obligado a cumplirlas.<\/p><h3>24. Comunicaci\u00f3n<\/h3><p>Los avisos oficiales se realizar\u00e1n a trav\u00e9s de <a href=\"mailto:support@nocticraft.com\">support@nocticraft.com<\/a> o canales de Discord acordados.<\/p><h3>25. Asignaci\u00f3n<\/h3><p>NoctiCraft puede transferir este Acuerdo a afiliados o sucesores sin consentimiento adicional.<\/p><h3>26. Entire Agreement<\/h3><p>Este documento representa el entendimiento completo y reemplaza cualquier discusi\u00f3n o representaci\u00f3n previa.<\/p><h3>27. Divisibilidad<\/h3><p>Si alguna cl\u00e1usula se considera inv\u00e1lida, el resto del Acuerdo permanecer\u00e1 en vigor.<\/p><h3>28. Ley aplicable y resoluci\u00f3n de disputas<\/h3><p>Este Acuerdo se rige por la ley espa\u00f1ola. Cualquier disputa deber\u00e1 abordarse primero comunic\u00e1ndose con <a href=\"mailto:support@nocticraft.com\">support@nocticraft.com<\/a>.
